I want to change the employer
I want to change the employer or a job function with the same employer. What should I do?
An foreigner is allowed to change the employer or a job function with the same employer during the validity term of the possessed temporary residence permit.
If you apply for a change of employer or job function with the same employer, you are not subject to the quota.
First of all, you must electronically via the Lithuanian Migration Information System (MIGRIS) fill-out the application for a permit for the renewal of employer or job function and include digital copies of the documents being added to this application. After filling-out the application and booking the visitation time via MIGRIS, within 4 months from the day of filling-out the application via MIGRIS you must personally address in regards to the issuance (changing) of temporary residence permit and submit the biometric data, as well as original documents. These documents shall be added to the application:

- valid travel document;
- the number of the mediation letter submitted by the new employer or by the same employer (in case of a change of job function) via the Lithuanian Migration Information System (MIGRIS) (to be indicated in MIGRIS when filling in the application for permission to change employer or job function with the same employer). The employer has to pay a stamp duty of EUR 50 to complete the mediation letter;
In the mediation letter, your employer states that you:
- intend to work under an employment contract; or
- intend to work under a temporary employment contract; or
- intend to work under an employment contract after completing your studies or formal vocational training in Lithuania, if you apply for a temporary residence permit within 10 years of completing your studies or formal vocational training; or
- intend to work under an employment contract when you have been granted temporary protection, or have a temporary residence permit issued on the grounds that you cannot return to your country of origin because you are being persecuted by an undemocratic regime.
If you are going to work under an employment contract, the employer in the mediation letter:
- undertakes to employ you on a full-time employment contract for at least 6 months;
- indicates whether the contract is a multi-employer employment contract. In the case of a multi-employer employment contract, the first employer will submit the mediation letter via MIGRIS, indicating the other employers (up to a maximum of 3 additional employers);
- confirms that the employer, or all of your employers (in the case of a multi-employer employment contract), has been carrying out the activity for which you are being invited for at least the last 6 months;
- provides information either on the qualifications you possess in relation to the work to be done and on your work experience of at least one year in the last 3 years in relation to the work to be done, or on the monthly salary you are expected to be paid, which must be at least equal to the average monthly gross salary for the calendar year most recently published by the State Data Agency, except the following, you have completed your studies or formal vocational training in the Republic of Lithuania and intend to work within 10 years of completing your studies or formal vocational training, or you have been granted temporary protection.
If you are going to work under a temporary employment contract, the employer in the mediation letter:
- confirms that it is included in the list of temporary employment companies maintained by the State Labour Inspectorate;
- undertakes to employ you on a temporary employment contract for a minimum period of 6 months and to set a full-time working time standard;
- undertakes to pay you a monthly salary during your employment in Lithuania of at least the average monthly gross salary for the calendar year published by the State Data Agency, and between secondments - at least 1 MMS;
- confirms that the temporary employment company has been carrying out the activity for which you are being recruited for at least the last 6 months;
- provides information on your qualifications relevant to the work to be done and your work experience of at least 1 year in the last 3 years relevant to the work to be done.
IMPORTANT! The employer must make sure you have documents proving your qualification (diploma, certificate, etc.) and that you have at least one year's work experience in the last 3 years relevant to the job you are doing (work book, certificate from your current and/or former employer).
You will need to pay a state fee:
- for submission of application to change the employer or the job title at the same employer and the release of decision on it – 100 Euro.
For a permit to change the employer or job title, you are requested:
- to arrive within your pre-booked timeslot at a relevant territorial office of the Migration Department;
Important:
- The decision on a permit to change the employer or the job title is made within 1 month.
- The decision on a permit to change the employer or the job title is valid for 1 month after the decision is made. One month after the date of the decision to allow a change of employer or job function, if you want to change employer or start working in a new job function, you must submit a new application for permission to change employer or job function. You can also opt not to take advantage of the Migration Department's decision to change employer and continue working for your previous employer.

Once you have completed the application and booked a visit via MIGRIS, you must apply in person for a change of employer and submit the original documents within 4 months from the date of completing the application via MIGRIS. if a multi-employer contract is to be concluded, the first employer submits the mediation letter via MIGRIS, indicating the other employers.
The mediation letter shall:
- where your professional activity is not regulated, indicate the high professional qualifications you hold and confirm that your high professional qualifications are relevant to the work you have done.
The employer must be satisfied that you have documentation confirming your high professional qualifications (a higher education diploma or a document confirming that your professional experience is equivalent to a higher education qualification);
- indicate whether you will be covered by a multi-employer contract (if so, the details of the other employers: company or individual's company number, name of the company or individual's name).
3. a document confirming that you meet the conditions set out in Lithuania to pursue a regulated professional activity when your professional activity is regulated.
4. if you intend to take-up high qualification work as the head of the company, document issued by Public Body “Invest Lithuania” affirming that the employer, who is intending to employ you to perform high vocational qualification work as the head of the company, is the company established in the Republic of Lithuania, the annual income of its participant (company or company group established in the foreign country) within the last three financial years (if the company is active for less than three years - from the date of establishment) and until the day of submitting the request at least during one financial year is no less than 1,000,000.00 EUR;
You will need to pay a state fee:
- for submission of application to change the employer or the job title at the same employer and the release of decision on it – 100 Euro.
For a permit to change the employer, you are requested:
- to arrive within your pre-booked timeslot at a relevant territorial office of the Migration Department;
Important:
- The decision on the authorisation to change employer must be taken within 14 calendar days of the date of receipt of the application;
- The decision to authorise a change of employer is valid for 1 month from the date of its adoption.
No, you do not have to get a new temporary permit in case you change the employer or the job title at the same employer.
You can start working for your new employer or change the job functions with the same employer only after you get a decision of the Migration department allowing you to change the employer or the job functions. The decision allowing to change the employer or job functions with the same employer is valid for 1 month after the date of decision.
Please note that if you do not start working for the new employer or do not change your job functions within 1 month, the decision will lose its validity and you will be required to submit a new application for change of the employer or the job functions with the same employer or an application for issue of a new temporary residence permit.
