I am temporarily transferred for work or research purposes to a host company established in the Republic of Lithuania
What does an intra-corporate transfer mean?
Intra-corporate transfer means the temporary secondment of an alien, who at the time of application for a temporary residence permit is a resident of a non-EU country, from an undertaking established outside the territory of EU Member State to which the non-EU-country resident is bound by a work contract to a host company established in the Republic of Lithuania for work or training purposes and the movement of this alien between host undertakings established in the EU Member States.
What is a host company?
Host company - a representative office, branch or company belonging to the same group of companies as defined in the Law on Consolidated Financial Statements of Groups of Companies of the Republic of Lithuania, its representative office or branch established in the Republic of Lithuania or another EU country Member State and to which an alien is transferred within the company.
I will often need to travel between different EU countries. Which country should I contact first?
You must obtain a temporary residence permit in the EU country of your first entry or where you come for the longest period of time.
How do I get a temporary residence permit?
A temporary residence permit is issued in the following cases:
You must first submit an application for an issue or renewal of a temporary residence permit electronically through the Lithuanian Migration Information System (MIGRIS) and attach the digital copies of the supporting documents to the application. Upon submission of application and after booking the visit time through MIGRIS, you must apply for a temporary residence permit (renewal) in person within 4 months from the date of submission of the application through MIGRIS and submit your biometric data and the originals of the supporting documents attached. Document supporting the grounds for issue or renewal of a temporary residence permit:
- mediation letter from the host company established in the Republic of Lithuania submitted through the Lithuanian Migration Information System (MIGRIS) (filling in an application the number of mediation letter must be indicated).
The mediation letter must indicate the intended movement of the intra-corporate transferee to the host companies established in other EU Member States (regardless of whether the transfer to a host company established in another EU Member State will last for a maximum of 90 days within a 180-day period or longer).
- a document proving that a company established in the Republic of Lithuania is a representative office, a branch or an enterprise belonging to the same group of companies, established in a foreign state which is not an EU Member State;
- an employment contract with a company established in a foreign country which is not an EU Member State;
letter of appointment from a company established in a foreign country which is not an EU Member State;
The letter of appointment must indicate the duration of the intra-company transfer, the address (es) of the head office (s) of the host company (s), the position to which the foreigner is transferred inside the company, and the salary paid to him, also the commitment that after the end of the period of the intra-company transfer, the foreigner will be transferred back to a company established in a foreign country that is not an EU Member State.
- a document confirming you will manage the host company established in the Republic of Lithuania or its structural unit, you will have subordinate staff, the authority to control the work of the staff and perform actions related to its management. This can be confirmed, for example, by an employment contract, a letter of appointment, a document confirming the organizational structure of the company;
- documents confirming that you have the necessary qualifications and professional experience for the host company established in the Republic of Lithuania. This can be confirmed, for example, by a higher education diploma, a curriculum vitae of a foreigner;
- a document proving that you have worked for at least the last 6 months prior to your arrival in the host company established in the Republic of Lithuania in a company established in a foreign country that is not an EU member state, whose representative company or branch is this host company, or in a company belonging to the same group. This may be confirmed, for example, by employment contract;
- If your monthly salary under employment contract is less than 1 minimum gross monthly salary, you will need to submit a proof of sufficient means of subsistence.
The amount of subsistence is 1 minimum gross monthly salary. A bank statement is an acceptable evidence of sufficient means of subsistence.
- The undertaking (confirmation) that you will declare your place of residence in a dwelling with a living area of at least 7 square metres for each adult declaring his/her residence (to be ticked when completing the application via MIGRIS);
- Certificate of (non) conviction
Certificate of (non) conviction is required only when applying for a temporary residence permit for the first time. These are certificates issued by the competent authorities of foreign countries where you have been living or are currently living for the last 2 years before your arrival to Lithuania (except when your living in a foreign country has lasted less than 6 months within a 12-month period), confirming whether you were (or not) convicted in these countries, which must be issued not earlier than 6 months before the date of application for a residence permit, translated into Lithuanian, as well as legalized and (or) certified by an Apostille, if required. If you have been convicted, the certificate must state when and for what criminal offense you were convicted, what sentence you have been charged with and whether it was served.
A certificate stating that you have (or have not) been convicted may be submitted in English, if originally issued in this language, or translated into English from the document's original language and certified with the signature of a translator.
Health insurance document
Health insurance must meet the following requirements:
- the insurance must guarantee coverage of emergency medical assistance costs, as defined in the Law on the Health System of the Republic of Lithuania, and the costs that may arise due to the return of an alien to a foreign country for health reasons (transportation, including escort of a personal health care professional (s)); and
- the insurance must be valid for the entire period of validity of the requested temporary residence permit or for at least one year.
You do not need health insurance if the compulsory health insurance contributions are being paid (will be paid) for you.
A foreigner can provide health insurance by option:
- when filling in the MIGRIS application;
- upon arrival to the Migration Department at the reserved time of the visit to submit documents and biometrical data;
For obtaining of a temporary residence permit you are requested:
- to arrive within your pre-booked timeslot at International House Vilnius (Konstitucijos pr. 3, Vilnius) or at a relevant territorial office of the Migration Department; or
- you able to apply for a temporary residence permit through an external service provider when you are absent from Lithuania.
For renewal of a temporary residence permit you are requested:
- to arrive within your pre-booked timeslot at International House Vilnius (Konstitucijos pr. 3, Vilnius) or at a relevant territorial office of the Migration Department.
You have to pay a state tax fee for accepting of application, processing, decision taking and issuance of the temporary residence permit:
- regular procedure - 160 Euro;
- urgent procedure - 320 Euro.
Decisions regarding the issuance/changing of the temporary residence permits are accepted and temporary residence permits are issued:
- Based on the general procedure - within 1 months;
- Based on the urgent procedure - within 15 days.
A temporary residence permit will be issued or renewed for the duration period of the transfer to a host company, established in the Republic of Lithuania, however not longer that for 3 years.
Important:
- upon arrival at the Migration Department at the reserved time of the visit, your stay in Lithuania must be legal;
- staying legally in Lithuania, you are entitled to start working at the host company from the date your application for issuance of a temporary residence permit is accepted;
- upon submission of an application for the issue or renewal of a temporary residence permit, you may be issued a national visa for a period not exceeding 5 months from the date of submission of the application for the residence permit.

- a document that you have the necessary special methods or management knowledge in the field of activity necessary for the host company established in the Republic of Lithuania (i.e., high professional qualifications and professional experience related to the type of work or activity requiring specific technical knowledge). This can be confirmed, for example, by a higher education diploma, a curriculum vitae of a foreigner;
- A document proving that you have worked for at least the last 6 months prior to your arrival in the host company established in the Republic of Lithuania in a company established in a foreign country that is not an EU member state, whose representative company or branch is this host company, or in a company belonging to the same group. This may be confirmed, for example, by employment contract.
- If you are going to work in a regulated profession, you will need a document confirming that you meet the conditions established in Lithuania for carrying out a regulated professional activity.
- If your monthly salary under employment contract is less than 1 minimum gross monthly salary, you will need to submit a proof of sufficient means of subsistence.
The amount of subsistence is 1 minimum gross monthly salary. A bank statement is an acceptable evidence of sufficient means of subsistence.

- internship contract.
The internship agreement must confirm that you are being transferred within the company for career development purposes or that you have acquired knowledge of business methods or techniques, and include the internship program, its duration and the conditions under which you will be supervised;
- a document, proving you have a university degree. This can be confirmed by a higher education diploma;
- document that when transferred within the company you will receive a salary;
- a document proving you have worked for at least the last 3 months before arriving at the host company established in the Republic of Lithuania in a company established in a foreign country that is not an EU member state, whose representative office or branch is this host company, or in a company belonging to the same group. This may be confirmed, for example, by employment contracts;
- if you are going to work in a regulated profession, you will need a document confirming that you meet the conditions established in Lithuania for carrying out a regulated professional activity.

How can I declare place of residence in the Republic of Lithuania?
If you are applying for a residence permit in the Republic of Lithuania, you can declare your place of residence as you choose:
- through the Migration Department, at the time of the reserved visit, by presenting the original documents and biometric data attached to the application for a residence permit;
- at the municipality or municipality within 1 month of collecting the residence permit.
When completing the application for a residence permit in the Republic of Lithuania via the Lithuanian Migration Information System (MIGRIS), you must indicate whether you wish to declare your place of residence via the Migration Department and confirm that you undertake to declare your place of residence in a suitable accommodation, where necessary.
If you did not confirm when completing the application for a residence permit that you undertake to declare your residence in a suitable accommodation, where necessary, you can add the form of Form of Undertaking In Regards to the Declaration of Place of Residence to the "Comments" section of the documents attached to the application.
If you choose to declare your place of residence through the Migration Department when applying for a residence permit in the Republic of Lithuania:
- The declaration of residence data must be provided when completing your application, and you do not need to complete a separate declaration of residence.
- When you fill-out the request to issue the residence permit via ‘MIGRIS’, you must add documents affirming your right to declare the place of residence in the dwelling. This can be:
- The consent of the owner, co-owner or their authorized representative of the dwelling to live in the dwelling belonging to the owner (co-owners). The consent of the owner (co-owner) must be confirmed by the notary or elder.
If non-confirmed consent of the owner (co-owner) is submitted, the owner (co-owner) must arrive at the Migration Department with you at the booked visitation time - the employee of the Migration Department accepting your request will confirm the consent of the owner (co-owner).
If the personal identification number has been given to the alien, for whom someone commits, in the Republic of Lithuania, consent may be concluded via www.igalojimai.lt. By choosing this method, in the description of the power of attorney service, the owner (co-owner) shall indicate that they agree to allow to settle-in and declare the place of residence in the dwelling belonging to the owner (co-owner) based on the right of ownership, by indicating the address of the dwelling. In this case, you will have to indicate the identification code given to the power of attorney to the employee of the Migration Department.
The Form of Consent to Settle-In at the Dwelling Belonging to the Owner (Co-Owner).
- Lease or loan-for-use agreement is concluded with the natural person or legal entity. The agreement need not be notarized or registered at SE “Centre of Registers”;
- Letter issued by the legal entity confirming the right to settle-in the premises belonging to the legal entity or the document confirming about the accommodation at the hotel, or the granted hostel.
When filling-out the request to issue the temporary residence permit, one of the aforementioned documents may be added to the column “Document Regarding the Suitable Dwelling in the Republic of Lithuania” (lith. Dokumentas dėl tinkamos gyvenamosios patalpos Lietuvos Respublikoje).
You may also submit the aforementioned documents upon arriving at the Migration Department at the booked visitation time in order to submit to the request the biometric data and original documents.
If the dwelling belongs to you on the right of ownership or the lease, or loan-for-use agreement concluded with the natural person or legal entity is registered in the SE “Centre of Registers”, you need not submit the documents confirming these circumstances to the Migration Department.
If you choose to declare your place of residence in the township after withdrawing the residence permit:
After withdrawing the residence permit at the Migration Department, within 1 month from the day of withdrawing the document, you will have to go to the township and declare your place of residence in accordance to the procedure determined by the Director of SE “Centre of Registers”.

Administrative liability may be applied for non-adherence to the requirement to declare your place of residence in Lithuania.
Can I bring family members?
Yes, you can. Family members are: your spouse, registered partner, unmarried and dependent underage children, your dependent parents if you have been supporting them for at least 1 year and they are unable to use the assistance of other family members living abroad.
They can apply for temporary residence permits at the same time as you. They will be issued temporary residence permits for the same period as your temporary residence permit. When do I have to apply for the renewal of a temporary residence permit?
An application for the renewal of a temporary residence permit with the accompanying documents must be submitted at least 1 workday before the expiry of the temporary residence permit, but not earlier than 4 months in advance.
Do I need a work permit in the Republic of Lithuania?
You are exempted from the obligation to obtain a work permit in the Republic of Lithuania.
How much time can I spend in the European Union?
You cannot spend more than 3 years as an intra-corporate transferee in the European Union as a whole. At the end of the transfer period, you must return to the sending company established outside the EU.
Can I be transferred several times within the company?
If you have already received a temporary residence permit, as a transferee within the company and then left, you can apply for a new temporary residence permit, as a transferee within the company, no earlier than 3 months after the transfer.

You have the right to enter and stay in the Republic of Lithuania without a visa for a maximum of 90 days within a 180-day period, as well as to work in the host company established in the Republic of Lithuania.
If you have an ICT temporary residence permit issued by another EU Member State which is not a Schengen state, then the host company established in the Republic of Lithuania must submit a written notice to the Migration Department about the planned trasfer, including the movement between the host companies located in other EU member states, by indicating the duration of the transfer as well registered office adress (-s) of the host company (-ies). The notice has to be submitted via MIGRIS.
Notice about your intended transfer to host companies established in other EU Member States (regardless of whether your transfer to a host company established in another EU Member State will take a maximum of 90 days in a 180-day period or longer) must be included in the application to issue a temporary residence permit or the host company established in the Republic of Lithuania must inform the Migration Department within 7 days at the latest from the date such circumstances became apparent (the notification shall be submitted via MIGRIS).
What are the conditions for long-term mobility between the host companies established in EU Member States?
If you are arriving to a host company, established in the Republic of Lithuania for longer than 90 days within the 180 days period, you may be issued a temporary residence permit.
You must first submit an application for an issue or renewal of a temporary residence permit electronically through the Lithuanian Migration Information System (MIGRIS) and attach the digital copies of the supporting documents along with the application. - a valid temporary residence permit issued by another EU Member State for an alien as an intra-corporate transferee;
- If you are going to work in a regulated profession, you will need a document confirming that you meet the conditions established in Lithuania for carrying out a regulated professional activity.
- If your monthly salary under employment contract is less than 1 minimum gross monthly salary, you will need to submit a proof of sufficient means of subsistence.
The amount of subsistence is 1 minimum gross monthly salary. A bank statement is an acceptable evidence of sufficient means of subsistence.
- An undertaking (confirmation) that you will declare your place of residence in a dwelling with a living area of at least 7 square metres for each adult declaring his/her residence (to be ticked when completing the application via MIGRIS);
- Certificate of (non) conviction;
Certificate of (non) conviction is required only when applying for a temporary residence permit for the first time. These are certificates issued by the competent authorities of foreign countries where you have been living or are currently living for the last 2 years before your arrival to Lithuania (except when your living in a foreign country has lasted less than 6 months within a 12-month period), confirming whether you were (or not) convicted in these countries, which must be issued not earlier than 6 months before the date of application for a residence permit, translated into Lithuanian, as well as legalized and (or) certified by an Apostille, if required. If you have been convicted, the certificate must state when and for what criminal offense you were convicted, what sentence you have been charged with and whether it was served.
A certificate stating that you have (or have not) been convicted may be submitted in English, if originally issued in this language, or translated into English from the document's original language and certified with the signature of a translator.
- Health insurance document
Health insurance must meet the following requirements:
- the insurance must guarantee coverage of emergency medical assistance costs, as defined in the Law on the Health System of the Republic of Lithuania, and the costs that may arise due to the return of an alien to a foreign country for health reasons (transportation, including escort of a personal health care professional (s)); and
- the insurance must be valid for the entire period of validity of the requested temporary residence permit or for at least one year.
You do not need health insurance if the compulsory health insurance contributions are being paid (will be paid) for you.
For obtaining of a temporary residence permit you are requested:
- to arrive within your pre-booked timeslot at International House Vilnius (Konstitucijos pr. 3, Vilnius) or at a relevant territorial office of the Migration Department; or
- you able to apply for a temporary residence permit through an external service provider when you are absent from Lithuania.
For renewal of a temporary residence permit you are requested:
- to arrive within your pre-booked timeslot at International House Vilnius (Konstitucijos pr. 3, Vilnius) or at a relevant territorial office of the Migration Department.
Decisions regarding the issuance/changing of the temporary residence permits are accepted and temporary residence permits are issued:
- Based on the general procedure - within 1 month, if transferred as a manager or a specialist;
- Based on the urgent procedure within 15 calendar days, if transferred as a manager or a specialist;
- Based on the general procedure - within 2 months, if transferred as an employee-trainee;
- Based on the urgent procedure - within 1 month, if transferred as an employee-trainee.
You have to pay a state tax fee for accepting of application, processing, decision taking and issuance of the temporary residence permit:
- regular procedure - 160 Euro;
- urgent procedure - 320 Euro.
A temporary residence permit will be issued or renewed for the duration period of the transfer to a host company, established in the Republic of Lithuania, however no longer than for 3 years, if you are transferred as a manager or a specialist, and no longer than for 1 year if you are transferred as an employee – trainee.
Important:
- you are entitled to start working at the host company from the date your application for issuance of a temporary residence permit is accepted.
Notice about your intended transfer to host companies established in other EU Member States (regardless of whether your transfer to a host company established in another EU Member State will take a maximum of 90 days in a 180-day period or longer) must be included in the application to issue a temporary residence permit or the host company established in the Republic of Lithuania must inform the Migration Department within 7 days at the latest from the date such circumstances became apparent (the notification shall be submitted via MIGRIS).
What are the procedural safeguards for a decision to issue a temporary residence permit (ICT) to be made?
If the application of an alien for the issue or renewal of a temporary residence permit is being processed under the urgent procedure basis and it is established that the supporting data and / or the documents submitted are insufficient to make a decision on the issue or renewal of a temporary residence permit, the Migration Department no later than 3 working days before the processing deadline of the application for the issue or renewal of temporary residence permit on urgent basis shall inform the alien that his / her application will be processed in accordance with the regular procedure, indicate the reasons for such a decision and send a digital copy of the certificate on the refund of the unused part of the state fee.
If an alien has not submitted biometric data or the data and / or documents supporting the application for the issue or renewal of a temporary residence permit are not sufficient to make a decision on the issue or renewal of a temporary residence permit, the Migration Department no later than within one month shall send a scanned notice to the alien to the e-mail address specified in the application for the issue or renewal of a temporary residence permit stating that biometric data have not been submitted and / or the data and / or documents supporting the application for the issue or renewal of a temporary residence permit are insufficient to make a decision on issuing or renewal of a temporary residence permit. This notification shall specify the data and / or documents required to be submitted to the Migration Department and shall set a reasonable deadline for the submission of biometric data or the required data and / or documents. This notice shall also state that the time limit for processing the application for issue or renewal of a temporary residence permit shall be suspended from the date of dispatch of that notice and will be resumed from the date of receipt of the data and / or documents or biometrics required for the decision to issue or renew the temporary residence permit.
A decision on refusal to issue or renew a temporary residence permit to an alien may be appealed to the Vilnius Regional Administrative Court within 14 days from the date of receipt of the decision.
What sanctions may be applied to a host company established in the Republic of Lithuania?
Article 542 "Failure to notify of changes in alien data" section 3 of the Code of Administrative Offenses states the following: Failure to provide timely information to the Migration Department under the Ministry of the Interior of the Republic of Lithuania on the change of the conditions applicable to the intra-corporate transfer of an alien under the Law of the Republic of Lithuania "On the Legal Status of Aliens" shall impose a fine on the head of the host company established in the Republic of Lithuania or his authorized person from one hundred forty up to up to six hundred Euros.
