ISSUANCE OF NATIONAL VISAS (D) TO THE ALIENS ARRIVING TO WORK

As of 2009, an alien (a citizen of a third country) who intends to work for an undertaking indicated in a work permit in the Republic of Lithuania issued to the alien by the Lithuanian Labour Exchange at the Ministry of Social Security and Labour of the Republic of Lithuania (hereinafter referred to as the “work permit”) may be issued a multiple entry national visa (D) valid for a period indicated in the work permit, but no longer than for one year.

In this case, the following documents are to be submitted for the issuance of the multiple entry national visa (D) to a diplomatic mission or consular post of the Republic of Lithuania abroad:

1. An application of the inviting undertaking of the Republic of Lithuania for the issuance of the multiple entry national visa (D). This application is addressed to a diplomatic mission of the Republic of Lithuania abroad which the alien is going to apply to for the issuance of the visa.

The application must indicate:

  • the main particulars of the undertaking (name, legal form, registered office, code, the Register of Legal Entities, in which data on this person are accumulated and stored, the VAT payer’s code (where the legal person is a VAT payer), address, telephone number, fax number), the name and surname, position, telephone number and signature of a representative of the legal person;
  • the alien’s name and surname, date and place of birth, sex, citizenship, the series and number of the travel document, the address of the place of residence in the state of origin, the purpose of the arrival, the date of the arrival in the Republic of Lithuania, the address of the premises where the alien will be accommodated during his stay in the Republic of Lithuania, the name and surname of the owner of these premises or the name, address and telephone number of the hotel where the alien will be staying;
  • the commitment to provide the alien with a proper accommodation and, where necessary, to cover the expenses of the alien’s return to a state which the alien has the right to be admitted to.

2. A copy of a work permit in the Republic of Lithuania issued to the alien by the Lithuanian Labour Exchange at the Ministry of Social Security and Labour of the Republic of Lithuania certified in accordance with the procedure laid down by legal acts.

The documents specified in Chapter II of the Description of the Procedure for Submitting Documents for the Issuance of a Visa, Issuing and Annulling the Visa, Consulting, Accrediting Tour Organisers and Travel Agencies and Inviting an Alien to Temporarily Stay in the Republic of Lithuania as approved by Order No 1V-280/V-109 of the Minister of the Interior of the Republic of Lithuania and the Minister of Foreign Affairs of the Republic of Lithuania of 2 September 2004 (Official Gazette, No 136-4961, 2004; No 36-1392, 2009; No 115-4914) are to be additionally submitted:

  • a document confirming the fact of payment of the consular fee. Where the alien is exempted from the consular fee in the cases specified by laws, he must submit the documents evidencing the circumstances under which he is exempted from this fee;
  • a valid travel document, whose period of validity must be at least three months longer than the period of validity of a visa requested to be issued;
  • a completed application for the issuance of a national visa of the established form;
  • one 35x45 mm colour photo corresponding to the person’s age;
  • a valid document confirming possession of medical insurance (the amount of medical insurance coverage is LTL 20 000);
  • the documents confirming the right to return to the country of origin or to a state whose citizen or permanent resident the alien is, or confirming the right to transit to a third country.

An alien who intends to continue (for the second year) working in an undertaking specified in his work permit must, not later than six months before the expiry of the multiple entry national visa (D) held by him, lodge an application and submit documents for the issuance of a temporary residence permit in the Republic of Lithuania to the migration division of a territorial police agency of the Republic of Lithuania according to his place of residence.

Note. As of 5 April, 2010, the aliens holding a valid national visa (D) may travel across the territory of other Schengen States for a period not exceeding three months during any period of six months.

In the event of termination of employment relations with the alien, an undertaking must apply in writing for annulment of a multiple entry national visa (D) to a diplomatic mission or consular post of the Republic of Lithuania abroad which has issued the visa or to the Migration Department under the Ministry of the Interior of the Republic of Lithuania (fax (8 5) 271 8612, (8 5) 271 8210). The application for the annulment of the multiple entry national visa (D) should indicate the alien’s personal data (his name and surname, birth of data, citizenship) as well as the date of termination of the employment contract with the alien.

Please note that until a visa is annulled, an undertaking remains under the obligation to cover, where necessary, the expenses of the alien’s return to a state which he has the right to be admitted to.
