After submitting the application to grant asylum you will be interviewed by a competent specialist.
If you need an interpreter, inform about it immediately. If you need legal assistance or medical assistance and another kind of help necessary for you or another person who arrived with you, inform the person who interviews you about this as well. Furthermore, you can contact a lawyer personally by using the phone numbers of the Lithuanian Red Cross Society, which are listed at the end of this brochure.
During the interview you will have to present all available documents and travel tickets, report your personal data, reasons for lodging asylum application and information on your travel route.
Only one European Union Member State can be responsible for examining your asylum application. For this reason Migration Department will carry out investigation to determine member state, which is responsible for examining your application.
If you are over 14 years old, your fingerprints will be taken.
Within 48 hours from lodging your application Migration Department will decide on granting you temporary territorial asylum pending the examination of your application as to substance and the taking of final decision or determination the state responsible for examining your asylum application. You can enjoy temporary territorial asylum during examination of your application for asylum in the Republic of Lithuania.
If the Migration Department will decide not to grant you temporary territorial asylum, you can appeal against this decision to the Vilnius Administrative Court within 14 days starting from the day when the decision is given. If you can not afford to reside in Lithuania by your own resources or you have entered the territory of the State or stay here illegally, you will be accommodated in the Foreigners’ Registration Centre, which is located in Pabradė, Švenčionys district.
If you wish to reside in Lithuania on your own resources, had entered the territory of the State and stay here legally (with valid travel documents and visa), according to the Migration Department’s decision you can be given a permission to reside in location of your choice. Your freedom of movement within the territory of the Republic of Lithuania may be restricted by the court’s decision on the grounds foreseen by the law. During the court hearing on the question of restriction of freedom of movement you have the right to free of charge legal assistance.
The Migration Department will have to examine your application for asylum within 3 to 6 months. If your application for asylum is rejected by the decision of the Migration Department, you can appeal against this decision to the Vilnius Administrative Court within 14 days starting from the day when the decision is given. The court, after examination your complaint, may satisfy it and oblige the Migration Department to review its decision. The court may also deny your complaint. During the examination of this complaint in the court you have the right to the free of charge legal assistance.
