Issuing a certificate confirming the right to restore the citizenship of the Republic of Lithuania

It is prescribed in the 1st part of the 9th clause of the Law on Citizenship of the Republic of Lithuania (hereinafter – the Law on Citizenship), that the persons, who were citizens of the Republic of Lithuania before 15June 1940, and their descendants, who have not acquired the citizenship of the Republic of Lithuania, have the termless right to reinstate the citizenship of the Republic of Lithuania, irrespectively of where they permanently reside – the Republic of Lithuania or in another country.

It is prescribed in the 12th clause of the Law on Citizenship, that according to the person’s, who have the right to reinstate the citizenship of the Republic of Lithuania, request the documents, confirming this right are issued by the Government of the Republic of Lithuania – the certificates, confirming the right to renew the citizenship of the Republic of Lithuania.

The persons, permanently living abroad can submit the application to issue (replace) the certificate, confirming the right to renew the citizenship of the Republic of Lithuania and the documents enclosed with it directly to the reception room of the Migration Department of the Republic of Lithuania by the Ministry of the Interior (hereinafter – the Migration Department) or through a diplomatic mission or a consular office in a foreign country, and persons, permanently living in the Republic of Lithuania – through the territorial police office according to the persons residency (hereinafter – territorial police office).

The person submits the application to issue (replace) the certificate, confirming the right to renew the citizenship of the Republic of Lithuania in person. The application to issue (replace) certificate, confirming the right to renew the citizenship of the Republic of Lithuania of children below the age of 18, and the incompetent persons is submitted by their representatives.

If the application to issue (replace) the certificate, confirming the right to renew the citizenship of the Republic of Lithuania is submitted by the persons representative, they have to supply the documents, confirming the identity of the person and the documents, confirming the representation.

The first name (s) and surname (s) are spelt in Latin characters without the secondary (diacritic) symbols, ligatures and other modifications of Latin alphabet letters in the request to issue the certificate, confirming the right to renew the citizenship of the Republic of Lithuania, according to the Latin records of the travel or other type of documents, confirming person’s identity. When typing person’s name (s) and surname (s), the following signs may be used: „.“, „’“, „( )“ and „/“.

The person, who has several names or a double surname, which consists of more than 31 symbols (first names and surname separately), put chosen first name (s) or first part of the double surname according to Latin records of the travel or other documents, confirming person’s identity, without diacritic signs.

The person’s request to issue (replace) the certificate, confirming the right to renew the citizenship of the Republic of Lithuania is investigated and a suitable decision is taken at the Migration Department.

The person is notified about the decision taken by the Migration Department in their chosen way.

The written certificate, confirming the right to renew the citizenship of the Republic of Lithuania can be claimed by the person at the Migration Department, at the diplomatic representative of the Republic of Lithuania or at the Consular office in a foreign country or the territorial police office in person or through their representative. If the certificate, confirming the right to renew the citizenship of the Republic of Lithuania is claimed by the person’s representative, they have to supply the documents, confirming their representation and identity. 

The certificate, confirming the right to renew the citizenship of the Republic of Lithuania is issued following the request from the person for unlimited time.

Together with the application to issue the certificate, confirming the right to renew the citizenship of the Republic of Lithuania the person submits:

  1. the documents, confirming that the person was a citizen of the Republic of Lithuania prior to 15th June, 1940 or is the descendant of a person who was a citizen of the Republic of Lithuania prior to 15th June, 1940. The documents, confirming that the person was a citizen of the Republic of Lithuania prior to 15th June, 1940 are:
    • domestic or foreign passports of the Republic of Lithuania, issued prior to 15th June, 1940;
    • domestic or foreign passports of the Republic of Lithuania, issued by diplomatic missions or consular offices of the Republic of Lithuania after 15th June, 1940;
    • the documents, testifying the person’s service at the Lithuanian army or work at the Lithuanian civil service;
    • birth certificates or other documents, directly stating the citizenship of the Republic of Lithuania;
    • personal testimonies, issued according to the documents, issued prior to 15th June, 1940
      If these documents do not exist, the citizenship, which the person had  prior to 15th June, 1940 can be confirmed by submitting documents about studying, working in Lithuania prior to 15th June, 1940, also the foreign state passport and other documents.
  2. the documents, confirming the blood relations with a person, who is or was Lithuanian, if a child or grandchild applies for the certificate, confirming the right to renew the citizenship of the Republic of Lithuania;
  3. the documents, confirming the change of first name or surname, if the person’s records in the submitted documents do not match the records in the travel document or other documents, confirming the person’s identity;
  4. two identical 40 x 60 mm personal photographs. 

Together with the request to replace the certificate, confirming the right to renew the citizenship of the Republic of Lithuania, the person submits:

  1. travel document or other document, confirming the person’s identity;
  2. the certificate, confirming the right to renew the citizenship of the Republic of Lithuania
  3. the documents, confirming the change of the first name or surname, if these personal records were changed after the issuance of the certificate, confirming the right to renew the citizenship of the Republic of Lithuania;
  4. two identical 40 x 60 mm personal photographs.

The application to issue (replace) the certificate, confirming the right to renew the citizenship of the Republic of Lithuania is completed in Lithuanian language.

If the person submits copies of the documents, their validity must be confirmed by the notary.

The documents, issued by other governments must be legalized or confirmed by a note (Apostille), if is it not scheduled otherwise by the international contracts of the Republic of Lithuania and the legislative enactments of the European Union, and translated into Lithuanian language (except for the travel documents, which are included in the Travel documents list, which honour the right to an alien to arrive to the Republic of Lithuania, approved by the Minister of Foreign Affairs and the Minister of the Interior 21 November, 2007 by the order No V-101/1V-397).

The person, who submits the application to issue (replace) the certificate, confirming the right to renew the citizenship of the Republic of Lithuania to the Migration Department or territorial police office, pays a state fee (for the investigation of the application to issue the certificate, confirming the right to renew the citizenship of the Republic of Lithuania –  15 EUR; for the investigation of the application to replace the certificate, confirming the right to renew the citizenship of the Republic of Lithuania – 6,30 EUR; for the issuance of the certificate, confirming the right to renew the citizenship of the Republic of Lithuania – 2,90 EUR at the time of submission, which is prescribed by the Government of the Republic of Lithuania for the issuance and rendering of documents regarding the certificate, confirming the right to renew the citizenship of the Republic of Lithuania.

The person, submitting the application to issue (replace) the certificate, confirming the right to renew the citizenship of the Republic of Lithuania to the consular institution for the acceptance and handover of the application for the certificate, must pay a consular fee, which is approved by the Government of the Republic of Lithuania.

The government fee must be paid before the institutions renders the service.

Note. The person can pay the government fees for the investigation of the application to issue (replace) certificate, confirming the right to renew the citizenship of the Republic of Lithuania in any city (district) of the country, irrespectively of where they submit the documents.
