Criminal Code of the Republic of Lithuania

Article 291. Unlawful state border crossing

A person who unlawfully crossed the state border of theRepublicofLithuania, shall be punished by a fine, arrest or by imprisonment up to two years.

  1. In accordance with this Article, paragraph 1, the alien shall be exempt from the criminal liability, if he unlawfully entered theRepublicofLithuaniawith the aim of asylum.
  2. The alien who did an offence provided in this Article, paragraph 1 with the intent to unlawfully pass from the territory of the Republic of Lithuania to the third country, in accordance with this Article, paragraph 1, he shall be exempt from criminal liability if in accordance with an established procedure he shall be sent to the country from the territory of which he unlawfully passed through the state border of the Republic of Lithuania or to the state, whose citizen he is.

Article 292. Unlawful human trafficking across the state border

  1. A person who unlawfully transported an alien without a permanent residence in theRepublicofLithuania, through the state border of theRepublicofLithuaniaor a person who unlawfully transported or concealed such an alien in the territory of theRepublicofLithuaniashall be punished by a fine or arrest or by imprisonment up to six years.
  2. A person who did an offence provided in paragraph 1 of this Article for selfish reasons or if it constituted a threat to a person’s life, shall be punished by imprisonment up to eight years.
  3. A legal person shall also be held responsible for the offences provided in this Article.

Article 292(1). The employment of nationals from third countries who unlawfully stay in the Republic of Lithuania

  1. The employer or his agent who employed for business purposes a national from third countries who unlawfully stays in the Republic of Lithuania or employed five or more nationals from third countries who unlawfully stay in the Republic of Lithuania or employed a national in particularly exploitative working conditions from third countries who unlawfully stays in the Republic of Lithuania or employed a minor national from third countries who unlawfully stays in the Republic of Lithuania, shall be punished by fine, arrest or imprisonment up to two years.
  2. A legal person shall also be held responsible for the offences provided in this Article.

Article 300. Forgery and possession of a forged document  

  1. A person who produced a false document, forged a genuine document or kept, transported, sent, used or realized a knowingly false or knowingly forged document shall be punished by a fine or arrest or by imprisonment up to three years.    
  2. A person who produced a false personal identity card, passport, driver‘s license or state social insurance card or forged a genuine personal identity card, passport, driver‘s licence or state social insurance card or kept, transported, sent, used or realized a knowingly false or knowingly forged genuine personal identity card, passport, driver‘s license or state social insurance card, shall be punished by arrest or imprisonment up to four years.
  3. A person who did the offences provided in paragraphs 1 and 2 of this Article, if because of that a significant damage was done or if he produced a large amount of false personal identity cards, passports, driver‘s licenses or state social insurance cards or if he kept, transported, sent, used and realized a large number of knowingly false or knowingly forged personal identity cards, passports, driver‘s licenses or state social insurance cards, shall be punished by imprisonment up to six years.
  4. A legal person shall also be held responsible for these offenses.
