How much time does it take to consider an alien’s application for the issuance or replacement of temporary residence permit?

An alien’s application for the issuance of the temporary residence permit must be considered not later than within four months from the lodging of the application to a Consular Post or Migration Service.

An alien’s application for issue of a temporary residence permit when the alien intends to work in the employment requiring high professional qualifications and submits a document confirming an employer’s commitment to hire him/her under an employment contract and pay a monthly salary, which is not lower than 2 and not higher than 3 average monthly gross salaries of employees of the country’s economy as last announced by the Department of Statistics of Lithuania, as well as an alien’s application for issue of a temporary residence permit on the grounds established in Article 45 (1) (1) of this Law, when the alien complies with the requirements of Article 45 (3) of this Law, including a permit for the alien’s family member, should be examined no later than within 2 months as from the date of submission of the application to an appropriate authority.

An alien’s application for issue of a temporary residence permit when the alien intends to work in the employment requiring high professional qualifications and submits a document confirming an employer’s commitment to hire him/her under an employment contract and pay a monthly salary, which is not lower than 3 average monthly gross salaries of employees of the country’s economy as last announced by the Department of Statistics of Lithuania, should be examined no later than within one month as from the date of submission of the application to an appropriate authority.

An alien’s application for the replacement of a temporary residence permit (i.e., issuance of a new permit) is considered no later than within two months from the lodging of the application to Migration Service. The application must be lodged for this permit at least two months before the expiry of the current temporary residence permit, but not earlier than four months before the expiry of the current permit.

If data and/or documents substantiating an application for the issuance or replacement of a temporary residence permit are insufficient, the authority authorized to make a decision on the issuance or replacement of a temporary residence permit shall inform about that a person having submitted the application for the issuance or replacement of a temporary residence permit within one month from the day of the receipt of such application in writing and set a reasonable deadline for the submission of the necessary data and/or documents. The deadline for the examination of the application for the issuance or replacement of a temporary residence permit shall be suspended from the day of sending the said letter and renewed from the day of receipt of the data and/or documents necessary for making a decision on the issuance or replacement of a temporary residence permit.

An alien can be refused to issue or replace temporary residence permit if it is established that one of the grounds indicated in Article 35 of the Law (changed) exists.
