5. Subparagraph 4 Of Paragraph 1 Of Article 101

A citizen of an EU Member State, when (s)he is a family member of the citizen of the EU Member State who arrives together with him/her or joins him/her (subparagraph 4 of paragraph 1 of Article 101 of the Law), must submit:

  1. an application of the specified form;
  2. a valid passport of an EU citizen or an identity card (the data must be verified against the EU citizen’s data indicated in the application);
  3. the documents confirming the ground for the issuance of the certificate:
    • document confirming the marriage or registered partnership agreement when EU citizen arrives together with EU citizen or joins EU citizen having a right to live in the Republic of Lithuania according to paragraphs 1, 2 and 3 of Article 101 of the Law or together with a citizen of the Republic of Lithuania or joins the citizen of the Republic of Lithuania (hereinafter – EU citizen having a right to live in the Republic of Lithuania) as a spouse or registered partner; or
       
    • documents confirming that EU citizen is a direct descendant of an EU citizen having a right to live in the Republic of Lithuania, his/her spouse or a person with whom a registered partnership has been formed, who has not reached the age of 21 years or who is a dependant, and the documents confirming dependence; or
       
    • documents confirming that EU citizen is a relative in the ascending line dependent on an EU citizen having a right to live in the Republic of Lithuania, his/her spouse or a person with whom a registered partnership has been formed and the documents confirming dependence; (these documents must be submitted only in such case when there are no such data in Population Register of the Republic of Lithuania); or
       
    • documents certifying that EU citizen is a cohabitant partner of EU citizen, who has a right to live in the Republic of Lithuania, who keeps permanent relationship with him/her for the past 3 years (for e.g. common agreement for accommodation rent or loan to acquire accommodation , birth certificate of their children);or
       
    • document certifying that EU citizen is dependent from EU citizen, who has a right to live in the Republic of Lithuania;or
       
    • documents certifying that EU citizen handles a common household with an EU citizen, who has a right to live in the Republic of Lithuania (for example, common agreement for accommodation rent or loan to acquire accommodation); or
       
    • documents certifying that EU citizen because of serious health issues needs personal help from EU citizen, who has a right to live in the Republic of Lithuania (for example, certificate form medical institution).

The copies of documents attached to the application must be certified in accordance to the procedure established by legal acts, the documents issued by foreign institutions must be legalised or certified by a note (Аpostille) in accordance with the procedure established by legal acts, with the exception of the cases when, according to treaties of the Republic of Lithuania or legal acts of the European Union, a document does not need to be legalised or certified with such note, it must be translated into Lithuanian, and the translations must be certified in accordance with the procedure established by legal acts.

Prior to lodging the application,  the state fee in the amount of 8,60 EUR  for the issuance of the certificate must be paid (there are no state fees for replacement of a certificate)
